CNN is reporting that a class action lawsuit has been filed in San Jose, California.

The lawsuit, filed by Hagens Berman Sobol Shapiro LLP on behalf of consumers against Apple computer, alleges that Apple was aware that its iPod Nano scratched “excessively during normal usage” and mislead consumers into believing it was durable.

The plantiff named in the lawsuit said that his iPod Nano became scratched so quickly that he could not view the screen.
